FEDERAL SENTENCING LAW- CHANGES IN THE USE OF ACQUITTED CONDUCT

Recent changes in the sentencing guidelines prohibit a judge from using acquitted conduct against a
person when that person is sentenced. Before the change in the law, a judge at sentencing could apply a
lower burden of proof and make a judicial finding that a person should be held accountable at
sentencing for the same conduct for which the jury acquitted that person at trial. In some cases,
sentences have doubled, or the court imposed a life sentence.
